1. Acceptance of Terms
By accessing or using PhoenixAlliance ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
PhoenixAlliance provides an AI-powered lead acquisition platform that sources and scores verified leads from our contact database, and uses Claude AI to generate personalized outreach drafts. The Service requires an active subscription. Gmail integration is optional and used solely to send outreach emails you have reviewed and approved.
3. Subscriptions and Billing
Access to the Service requires a paid subscription. Subscriptions are billed monthly via Stripe. You may cancel at any time; cancellation takes effect at the end of your current billing period and you retain full access until then. Fees are non-refundable except where required by law. Prices may change with 30 days' notice.
4. Acceptable Use
You agree to use the Service only for lawful business outreach purposes. You may not use PhoenixAlliance to send spam, harass individuals, violate CAN-SPAM or GDPR regulations, or engage in any activity that violates applicable law. You are responsible for all outreach sent from your account.
5. Third-Party Integrations
The Service integrates with Gmail, Stripe, and other third-party services. Your use of those services is governed by their respective terms and policies. PhoenixAlliance is not responsible for the availability, accuracy, or actions of third-party services.
6. Intellectual Property
The PhoenixAlliance platform, brand, and underlying technology are owned by PhoenixAlliance. AI-generated drafts produced by the Service may be used freely by you for your business purposes. You retain ownership of all data you provide to the Service.
7. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee specific results, including revenue generated, leads converted, or response rates. AI-generated content should be reviewed before sending.
8. Limitation of Liability
To the maximum extent permitted by law, PhoenixAlliance shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the three months preceding the claim.
9. Termination
We reserve the right to suspend or terminate accounts that violate these Terms. You may terminate your account at any time from your account settings.
